Terms of Service & Project Agreement
These terms govern all architectural and product 3D visualization services provided by Can Özgeç. Built on industry-standard ArchViz master service frameworks to ensure clarity, safeguard project deadlines, and establish clear revision boundaries across both Async and Live Design models.
1. Scope & Deliverables
Services proceed under either the Async Fixed-Quote model or the Live Design Service. For rendering and animation services, deliverables consist exclusively of final 2D rendered images or video cuts specified in the quote. For Solid Modeling services, deliverables consist of the agreed production 3D geometry files (STEP, FBX, OBJ). Proprietary 3D working scenes (.MAX, Corona/V-Ray shaders, lighting setups) remain studio IP.
2. Payment Structure & Watermarking
All projects follow a 3-stage milestone payment schedule: 40% deposit prior to kickoff, 40% upon approval of the untextured rough model (Clay draft), and 20% final payment upon preview sign-off prior to high-res file delivery. All progress previews contain digital watermarks; un-watermarked 4K assets release upon verified final payment.
3. 3-Stage Review & Revision Protocol
Production is partitioned into three locked milestones: Stage 1 (Clay geometry & camera framing), Stage 2 (Materials, lighting & environment draft), and Stage 3 (High-res post-production). For Async Fixed-Quote projects, each stage includes up to 2 rounds of standard adjustments. For Live Design Service projects, revisions are resolved interactively within booked live session blocks.
4. 3 Business Days (72-Hour) Deemed Acceptance Rule
The client agrees to review and provide consolidated written feedback within 3 business days (72 hours) of receiving stage previews. Failure to submit written feedback or rejection within 3 business days constitutes legal Deemed Acceptance, enabling the studio to proceed to the next phase.
5. Client Inputs & 14-Day Stagnation Fee
The client is responsible for supplying accurate CAD/BIM data and CMF finish schedules. If client feedback or asset delivery is delayed for more than 14 consecutive calendar days, the project is classified as Stagnant. Completed work to date is billed immediately, and reactivation incurs a Re-activation Fee.
6. Intellectual Property & Commercial License
Full worldwide commercial marketing rights for final rendered images transfer to the client upon receipt of full payment. The studio retains rights to showcase rendered visual assets in web portfolios (canozgec.com), social channels, and awards unless restricted by a signed NDA.
7. Raw 3D Source Files & Buyout Addendum
Editable 3D working scene files (.MAX, .BLEND, .RVT, V-Ray/Corona setups) remain the studio's proprietary trade secrets and are subject to third-party asset EULAs. Transfer of raw 3D working scene files requires a separate Source File Buyout Addendum subject to a 250% buyout fee.
8. Artistic Interpretation Disclaimer
Deliverables are artistic visual interpretations created solely for aesthetic design visualization and commercial marketing. Renders do not constitute stamped architectural blueprints, structural engineering schematics, or construction documents, and the studio bears no liability for real-world build tolerances.
